Canada's highest court struck down a federal law used to detain terrorism suspects, ruling that the measure doesn't ``conform to fundamental justice'' and giving the government a year to rewrite it.
The Supreme Court's nine-member panel ruled unanimously today that the use of ``security certificates'' to detain people deemed a threat to the country's security is illegal.
Federal authorities can detain suspects, following approval of a security certificate by either the minister of citizenship or minister of public safety, without laying specific charges and without providing all the facts to the suspects or their lawyers. Federal officials have said withholding the information is necessary to protect intelligence-gathering methods. *** To me, the 'security' certificate is a great compromise that I think we could use in the states - but requiring that a formal charge be brought against somebody before they can be detained is the ultimate goal right?
